The Appeal Court in Abuja reversed the judgement of the Federal High Court Abuja made on the 3rd of April 2019 which led to the sack of senator Peter Nwaoboshi as the People’s Democratic Party (PDP) for Delta North senatorial seat.
Justice Mohammed Idris who led the judge insisted that the suit by Nwoko was statute barred and that Justice Ahmed Mohammed of the Federal High Court Abuja should not have given any attention to the case talk less of delivering the judgement in favour of Nwoko.

The Three-man panel of the Appeal Court on Thursday said that the Federal High Court had no jurisdiction to had the case filed by Ned Nwoko.
On the 3rd of April 2019 verdict, Justice Mohammed sacked Nwaoboshi as the PDP candidate for the last election in Delta North senatorial district and ordered INEC to accept Nwoko as the party’s candidate.
This led to the withdrawal of the Certificate of return issued to the chairman Senate Committee on Niger Delta development commission (NDDC) and senator representing Delta North senatorial district of Delta state, Peter Nwaoboshi on the 11th of May, 2019.
The Certificate of return withdrawn from senator Nwaoboshi was given to Ned Neoko as senator-elect for Delta North Senatorial District at the INEC headquarter Abuja.
