Busola Dakolo, the wife of Nigerian musician, Timi Dakolo Busola, who was allegedly raped over 20 years ago, has urged her accused raper, Biodun Fatoyinbo who is the senior pastor and founder of the Commonwealth of Zion Assembly, to appear in court for the sake of justice.
Dakolo also told the FCT High Court in Abuja to dismiss the initial charges filed against her by Fatoyinbo.
She said this in response to the charges filed against her by Fatoyinbo, adding that she took him to court because of the continuous emotional trauma she is going through as a victim of rape which was committed by the COZA pastor.
She had accused him of allegedly raping her on diverse occasions when she was a teenager for more than 20 years ago.
Fatoyinbo was summoned on September 6 to appear before the court within 14 days of the service; otherwise, judgment would be given in his absence.
He, however, through his lawyer, Mr Alex Izinyon (SAN), attempted to dismiss the case by filing a preliminary objection dated September 20, saying that the case was filed out of time and the court cannot hear the matter again.
In response to this, Dakolo, through her Lawyer, Mr Pelumi Olajengbesi, told the court that the suite by Fatoyinbo was filed out of time and that it is predicated on the continuous injury which is an exception to the statute of limitation.
Dakolo, therefore, plead to the court not to permit her alleged raper to go without facing the justice by hiding under the cloak of the statute of limitation, adding that emotional distress is a tort that cannot be quantified by time.
